Foreign IP Counsel

As patent and/or trademark counsel outside of the U.S., you and your clients can take comfort in knowing that each of our IP lawyers prepares and prosecutes patent and trademark applications from a litigation perspective. The patents and trademarks that we have secured for clients have withstood attacks made before the courts and in reexamination proceedings, by those who have been accused of infringing such intellectual property rights. They also have served as the basis of lucrative licensing deals for our clients.

For example, with respect to patents, we follow the "Low Profile/Common Denominator" approach, espoused by the Patent Resource Group, to prepare and prosecute patent applications. This approach is aimed at, among other things, minimizing the risk that language in the written description will be imported into the claims, thereby narrowing the scope of the claims unwittingly. Other techniques, informed by decisions and trends of the Court of Appeals for the Federal Circuit, are used to craft winning patent claims that your clients will be able to enforce and license with confidence.

Sensitive to the potentially high costs of prosecuting U.S. patent applications, we will work in dual harness with you to ascertain the relative importance of each matter so as to tailor an approach that fits within your client's budget in view of such importance.

Notwithstanding our aforementioned proactive, value-added approach to preparing and prosecuting U.S. applications corresponding to foreign-filed cases, our fees are consistently lower than firms located in Tier 1 markets such as Washington D.C., Boston, Chicago, and Philadelphia.

It is also important to note that the Firm's lawyers travel to the U.K., Germany, Italy, and elsewhere to meet with foreign counsel with whom we are working not only with respect to matters for which we have been engaged by you, but also with respect to matters that we, in turn, will have referred to you on behalf of our U.S. clients.
